Virginia Notaries are "ministerial" officials, their powers are limited -- in contrast to "judicial" officials who are given broad discretionary authority by the law:
-
A Notary must never offer legal advice.
-
A Notary must never provide or draft documents for another person.
Notaries are not allowed to advise others in preparing or explaining documents, nor may a Notary help to draft or select a document.
A Notary may not choose for the signer what type of notarial act to perform, because this decision has legal ramifications. If a signer has a question about a document, a Notary must refer this person to an attorney or to the document's issuing or receiving agency.
VA notaries are not authorized to certify true copies of birth, death, or marriage certificates. Virginia notaries are not authorized to certify true copies of court issued documents, nor perform marriage ceremonies.
The limits of notarization.
Notarization only proves that the signer took the necessary oath or acknowledged the execution of an instrument. It does not prove that the contents of the document are correct, nor does it confer any legalization on the document. A document that is incorrect, false or fraudulent before notarization will remain so after notarization.


Apostilles.
We have extensive experience working with non-recordable documents and we can notarize any document that requires legal notarization for an apostille.​
​​An apostille is a certificate issued by a government agency and attached to a notarized document, confirming that the seal and signature of the Notary is valid, and the notarization can be accepted by the receiving agency in the foreign country.​​
​
Apostilles are specifically used by governmental agencies for documents going to the 156 countries that are signatories to the Hague Apostille Convention. Documents sent to countries that are not part of the Hague Convention may require additional certification from the U.S. Department of State.

Notaries do not issue or provide apostilles, nor may a Notary attach an apostille to a document. Only an authorized government agency can place the certificate of apostille on the document. An apostille cannot be issued unless the document is notarized.​​​​​

Apostille Requirements.​​
The process to obtain an apostille can vary depending on the authority that issues it, but generally, the following steps apply:

Identify the type of document and the issuing authority.

Authenticate the document by obtaining the necessary certification, such as a notary public seal or a court certification.

Submit the document, together with the application for an apostille, and pay the associated fees.

Wait for the processing time, which can range from a few days to several weeks, depending on the authority and the workload.
